This bill adds a new provision to the California Coastal Act that creates a temporary categorical exclusion from coastal development permit requirements for affordable housing projects in specific infill areas. By July 1, 2027, the California Coastal Commission must identify at least three local jurisdictions without certified local coastal programs where residential housing projects consisting entirely of deed-restricted very low, low, or moderate-income units can be developed without obtaining a coastal development permit. The categorical exclusion will remain in effect until June 30, 2037, or until the local jurisdiction receives a certified coastal program. When selecting these infill areas, the Commission must consult with the Department of Housing and Community Development, choose jurisdictions from various coastal regions with different population sizes, ensure the areas further fair housing goals, consider local housing element inventories, and avoid sites vulnerable to sea level rise. Developers must still obtain local land use approvals and request a notice of exclusion from the Coastal Commission before beginning construction. The Commission is required to publish maps of the categorical exclusion areas by August 1, 2027, and submit a report to the Legislature by January 1, 2035, detailing the number of projects constructed under this provision, with the goal of facilitating affordable housing development in coastal regions while maintaining environmental protections.
