AI Summary
This bill amends the California AI Transparency Act to introduce several new requirements for artificial intelligence (AI) systems, online platforms, and capture device manufacturers. Starting January 1, 2027, large online platforms with over 2 million monthly users will be required to detect and disclose provenance data (information about the origin and authenticity of digital content) for content distributed on their platforms, including providing a user interface that shows whether content was generated by AI or a specific capture device. Beginning January 1, 2028, capture device manufacturers will need to offer users the option to include latent (hidden) disclosures in captured content, revealing details like the manufacturer's name, device name and version, and creation time. The bill also prohibits GenAI (generative AI) hosting platforms from making available AI systems that do not place appropriate disclosures. Violations of these requirements can result in civil penalties of $5,000 per violation, which can be pursued by the Attorney General, city attorneys, or county counsel, with each day of violation considered a separate offense. The bill delays the original operative date of the California AI Transparency Act from January 1, 2026, to August 2, 2026, and includes a severability clause to ensure that if any part of the law is found invalid, the remaining provisions can still be enforced.
