This bill creates a pilot program for a work/incarceration prison in West Virginia, establishing a framework for a new type of correctional facility focused on rehabilitation and work opportunities. The bill allows one county to establish such a prison after developing and submitting a plan to the Division of Corrections for approval. Eligible offenders can receive a 20 percent sentence reduction for participating in the program, but must strictly adhere to established conduct rules. If an offender commits a serious rule violation, they will be transferred to a standard correctional facility and have an additional year added to their original sentence. The prison superintendent has the discretion to reject or remove offenders from the program. The Legislature may provide an initial $500,000 appropriation to help establish the facility, with the expectation that the prison will become self-sustaining through offender work products and services. The county can also choose to accept offenders from other counties and charge a fee for housing them. The Division of Corrections is required to conduct an annual evaluation of the program, assessing its effectiveness, efficiency, and potential for expansion to other counties, and report these findings to the Legislature.
