This bill establishes new requirements for safe storage of firearms in West Virginia, focusing on preventing minors from accessing guns without proper supervision. Under the proposed law, a person who owns or controls a firearm must keep it either in a securely locked box or container, in a location that a reasonable person would consider secure, or secured with a trigger lock, unless the firearm is being carried on their body or within immediate reach. If a minor gains unauthorized access to the firearm and either possesses it in a public place or exhibits it in a rude, careless, angry, or threatening manner, the firearm owner can be charged with a misdemeanor, facing up to 60 days in jail and/or a fine of $500. The law specifically excludes situations where the minor obtained the firearm through an unlawful entry by another person. The bill aims to reduce the risk of accidental or intentional gun-related incidents involving minors by promoting responsible firearm storage practices.
