This bill modifies Minnesota's earned sick and safe time (ESST) law by making several key changes to how employers must provide and track paid time off for employees. For employers with 25 or fewer full-time equivalent employees, earned sick and safe time will be paid at half the employee's normal hourly rate, and these employers are not required to provide paid ESST during their first 12 months of operation. The bill expands the list of employees who are exempt from ESST requirements, including minors under 18, seasonal workers, employees working fewer than 520 hours in a year, and per diem workers with flexible schedules. The accrual rate for ESST has been changed from one hour per 30 hours worked to one hour per 40 hours worked, with a maximum of 48 hours per year that can be carried over to 80 hours total. Employers can now impose a waiting period of up to 90 days before employees can use their earned time, and employees must provide notice at least two hours before a scheduled shift if the need for time off is unforeseeable. The bill also includes provisions about documentation requirements and mandates that employers provide written policies about ESST. Notably, the bill includes a penalty waiver, meaning the state will not impose monetary penalties for initial violations of ESST requirements until after January 1, 2026, giving employers time to adjust to the new regulations.
