This bill strengthens warning label and packaging requirements for cannabis products and expands criminal penalties for violations. The legislation amends the cannabis law to mandate that cannabis product packaging must have conspicuous, large, bold-face warnings that are clearly visible, including requirements to warn consumers to keep products out of reach of children and that they are only for people 21 and older. The bill also modifies the penal code to make certain violations of cannabis product packaging, advertising, marketing, and administration rules a criminal offense. Specifically, if a person knowingly sells more than five pounds of cannabis or two pounds of concentrated cannabis, or markets, packages, displays, labels, or administers cannabis products in a way that contravenes state cannabis regulations, they can now be charged with criminal sale of cannabis in the first degree, which is classified as a class D felony. The changes aim to enhance consumer safety, prevent youth access, and ensure proper handling and marketing of cannabis products by imposing stricter regulatory and criminal penalties for non-compliance.
