This bill modifies the existing law regarding court-appointed attorneys for children in dependency and termination proceedings by extending the timeline for statewide implementation from 7 to 11 years. The bill requires courts to appoint attorneys for children under specific age-based conditions: for children under 8, an attorney must be appointed when a termination petition is filed, and for children between 8 and 17, an attorney must be appointed when a new dependency petition is filed or at the shelter care hearing. The statewide children's legal representation program will develop a phased implementation schedule, starting with 3 counties in July 2022 and expanding to full statewide coverage by January 2032. The bill prioritizes implementation in counties with no current attorney appointment practice or significant racial disproportionality in dependent children populations. The state will cover the costs of these legal services, subject to appropriations, and the program is responsible for recruiting, training, and overseeing attorneys who must adhere to professional conduct rules and practice standards. The bill also requires the department and guardian ad litem to notify children aged 12 and older about their right to request an attorney and make this inquiry annually.
