This bill enacts the "PFAS Discharge Disclosure Act," which requires certain industrial facilities and Publicly Owned Treatment Works (POTWs) to monitor and disclose the presence of per- and polyfluoroalkyl substances (PFAS), a class of persistent and toxic chemicals that have contaminated water sources. The bill mandates that covered industrial dischargers and POTWs applying for or renewing State Pollutant Discharge Elimination System (SPDES) permits must conduct quarterly PFAS monitoring for one year, with potential ongoing monitoring if PFAS are detected at significant levels. Covered industrial users introducing wastewater to POTWs must also test for and report PFAS presence. The New York State Department of Environmental Conservation (DEC) will be responsible for setting detection levels for at least 40 PFAS chemicals and will make all monitoring results publicly available on its website. The goal is to gather comprehensive information about PFAS contamination in New York's waters, address gaps in current monitoring requirements, and ultimately develop more effective regulations to protect public health and the environment from these "forever chemicals." The act will take effect one year after becoming law, giving agencies time to prepare implementation procedures.
