Bill Summary
AN ACT To amend an Act to provide an additional homestead exemption from Gwinnett County school district ad valorem taxes for educational purposes in the amount of $2,000.00 of the assessed value of the homestead for residents of that school district who are certain public service employees, approved May 3, 2023 (Ga. L. 2023, p. 4346), so as to expand such exemption to disabled veterans and all employees of the Gwinnett County School District and the Buford City School District; to provide for compliance with constitutional requirements; to provide for a referendum, effective dates, and automatic repeal; to provide for mandatory execution of election and judicial remedies regarding failure to comply; to provide for related matters; to repeal conflicting laws; and for other purposes.
AI Summary
This bill expands an existing property tax exemption in Gwinnett County, Georgia, which currently provides a $2,000 reduction in school district property taxes for certain public service employees. The bill would extend this exemption to include disabled veterans and all employees of the Gwinnett County and Buford City School Districts. The expansion is contingent upon a voter referendum to be held during the 2026 general primary election, where voters will decide whether to approve the change. If approved by more than half of the voters, the exemption will take effect on January 1, 2027. The bill defines "public service employees" broadly, including firefighters, law enforcement officers, military members, hospital staff, and school district employees. The bill also includes provisions to ensure compliance with the election process, such as mandatory publication of the referendum details and the ability for voters to seek legal remedies if the election superintendent fails to conduct the election as specified. If the referendum is not approved or not properly conducted, the bill will be automatically repealed.
