This bill modifies New Mexico state law to expand the authority of local and county elected officials to allow off-highway motor vehicles (OHVs) like recreational off-highway vehicles and all-terrain vehicles to operate on paved streets and highways within their political boundaries. The bill removes previous restrictions that limited such authorization and establishes specific requirements for OHV operation on paved roads, including mandatory safety equipment (headlights, taillights, brakes, mirrors, mufflers), operator licensing, insurance, eye protection, and safety helmets for operators under 18. Additionally, the bill allows local and county authorities to establish separate speed limits and operating restrictions for OHVs on these roadways, while maintaining existing prohibitions on OHV use on state game commission and state parks lands. Operators of OHVs on paved streets will be subject to most Motor Vehicle Code requirements and penalties, with the exception of conflicting licensing and equipment standards. The legislation aims to provide more flexible local control over OHV street use while maintaining safety standards.
