Bill Summary

AN ACT RELATING TO FIREARMS; PROVIDING THAT THE REQUIRED WAITING PERIOD FOR THE SALE OF A FIREARM DOES NOT APPLY TO A BUYER WHO IS A CERTIFIED LAW ENFORCEMENT OFFICER OR A COMMISSIONED LAW ENFORCEMENT OFFICER WITH THE POWER TO MAKE ARRESTS.

AI Summary

This bill modifies existing New Mexico law regarding firearm sales waiting periods by creating specific exemptions for certain law enforcement officers. Currently, the law requires a seven-calendar-day waiting period for firearm sales, during which a federal background check must be conducted. The bill adds two new exemptions to this waiting period: one for law enforcement officers authorized to carry a firearm and certified under federal law or the Law Enforcement Training Act, and another for commissioned law enforcement officers with the power to arrest while performing official duties. These changes mean that law enforcement officers in these categories can purchase firearms without being subject to the standard seven-day waiting period. The bill maintains other existing exemptions, such as sales to federal firearms licensees, those with concealed handgun licenses, and sales between immediate family members. The underlying purpose appears to be providing law enforcement professionals with more immediate access to firearms they may need for their professional duties, while still maintaining background check requirements for other buyers.
