This bill amends New Mexico's procurement law to expand transparency requirements for sole source and emergency procurement contracts. The legislation requires state and local purchasing offices to more widely distribute information about these types of contracts before and after they are awarded. Specifically, when a sole source or emergency procurement contract is being considered or awarded, purchasing offices must now: 1) post information on the Sunshine Portal (a public transparency website), 2) email details to the Legislative Finance Committee, 3) send information to anyone who has requested it via email, and 4) provide the contract details to the Legislative Council Service for distribution to state legislators. The bill also standardizes the required contract information that must be publicly maintained, which includes the contractor's name and address, contract amount and duration, services or items procured, the type of procurement (sole source or emergency), and the justification for using that procurement method. These records must be kept for at least three years and are considered public records. The changes aim to increase government procurement transparency by ensuring more people have access to details about contracts awarded through non-standard procurement processes.
