This bill amends the Surface Mining and Reclamation Act of 1975 to create a new "Idle Reserve Mine Status" for surface mining operations that extract construction aggregate materials (such as sand, gravel, rock, and stone). Until January 1, 2032, surface mining operations can apply to the Division of Mine Reclamation for this status if certain conditions are met, including having reserves determined by the State Geologist to address future infrastructure needs and not being located on federal public land. If approved, the lead agency can extend the interim management plan for the mining site by up to 10 additional years beyond the current maximum 10-year renewal period. The bill requires the Division of Mine Reclamation to annually publish detailed information about surface mining operations, including those in Idle Reserve Mine Status, and mandates that the State Mining and Geology Board adopt regulations to implement these provisions. Additionally, the bill requires lead agencies to inspect idle and Idle Reserve Mine Status surface mining operations at least every 12 months to ensure compliance with existing regulations. The Legislature's intent is to minimize waste of construction resources while ensuring timely reclamation of idle mines and preventing indefinite delays in reclamation efforts.
