This bill modifies the local control funding formula for charter schools by allowing them to apply for a waiver from current limitations on concentration grant calculations. Currently, charter schools are restricted in calculating their concentration grants based on the percentage of unduplicated pupils (students who are English learners, foster youth, or eligible for free/reduced-price meals) to match either the school district where they are physically located or the district with the highest percentage of unduplicated pupils. Under this bill, a charter school can apply to the Superintendent of Public Instruction for a waiver to instead calculate its concentration grant based on its own percentage of unduplicated pupils exceeding 55% of its total enrollment. To receive the waiver, the charter school must demonstrate that the current limitation would cause a significant funding shortfall that negatively impacts its ability to serve pupils and that granting the waiver would provide a direct material benefit to its enrolled students. The Superintendent is required to develop guidelines and procedures for reviewing and approving such waiver applications, with the goal of providing more flexible funding options for charter schools.
