The bill allows conservators to place conservatees in residential care facilities for the elderly, residential facilities, intermediate care facilities, and skilled nursing facilities that have secured perimeters or delayed egress locks, but requires court approval based on clear and convincing evidence that the conservatee has a major neurocognitive disorder, lacks capacity to consent, and would benefit from a restricted environment. For subsequent placements in different facilities, court approval will be required if specific regulations have not been established. The bill also requires the State Departments of Social Services and Public Health to update their regulations by January 1, 2027, to create consistent standards for these facilities that protect residents' rights, health, and safety, and allows these departments to create emergency regulations before that date. The legislation aims to meet the unique needs of individuals with neurocognitive disorders while safeguarding their dignity and rights, and potentially reducing costs for conservatees, families, and government agencies.
