AN ACT to amend the labor law, in relation to establishing a model neurodiversity awareness training program

This bill directs the New York State Department of Labor, in collaboration with the Division of Human Rights and the Department of Health, to develop a comprehensive model training program on neurodiversity awareness for employers. The training program must be interactive and cover key topics including: a definition of neurodiversity (defined as the range of differences in brain function and behavioral traits considered part of normal human variation), examples of cognitive processing differences, best practices for creating supportive workplaces, information about the impact of neurodiversity ignorance, employee rights and complaint mechanisms, and other relevant content. Employers will be required to either use the state's model training program or establish an equivalent program that meets or exceeds its standards, and must provide this training to all employees annually. The Department of Labor will create training templates in multiple languages based on population demographics, and the training program will be reviewed and reapproved every two years by the Department of Labor and Division of Human Rights. The bill aims to increase understanding, appreciation, and support for neurodiverse individuals in workplace settings, with the training becoming mandatory 180 days after the bill becomes law.
