This joint resolution proposes to amend the New Mexico Constitution to create a permanent Interim Administrative Rule Oversight Committee with specific powers and composition. The committee would consist of 12 members, with three members appointed by each of the majority and minority floor leaders from both the house of representatives and the senate. The committee's leadership would rotate annually between the house and senate, and between the two political parties with the most members. Members would serve two-year terms, with provisions for replacement if they leave the legislature. The committee would be required to meet at least monthly between legislative sessions and would have the responsibility to review proposed executive agency rules, analyze their fiscal impact, make recommendations to agencies, suggest clarifications to authorizing statutes, and direct committee staff. Critically, the committee would have the power to recommend that the legislature overturn agency rules during a legislative session if the committee determines that a rule does not comply with its authorizing law. The proposed constitutional amendment would be submitted to voters for approval at the next general election or a special election called for this purpose.
