AI Summary
This bill transfers the licensing and oversight responsibilities for several types of health and mental health programs from the Department of Community Health to the Department of Behavioral Health and Developmental Disabilities (DBHDD), effective January 1, 2026. Specifically, the bill reassigns licensing authority for drug abuse treatment and education programs, narcotic treatment programs, community living arrangements, and adult residential mental health programs to DBHDD. The legislation includes detailed provisions for how this transfer will occur, such as maintaining existing licenses and regulations until they are updated, establishing new fee schedules, and creating comprehensive rules for licensing, inspections, and oversight of these programs. The bill also introduces new protections for residents of community living arrangements, including mandatory reporting requirements for suspected abuse or exploitation, immunity for good-faith reporters, and prohibitions against retaliation. Additionally, the legislation outlines the department's authority to investigate, impose penalties, and take emergency actions to protect residents' health and safety. The comprehensive approach ensures a smooth transition of regulatory responsibilities while maintaining critical oversight and resident protections across these healthcare and mental health service programs.
