This bill authorizes the City of Hercules to impose a transactions and use tax, which is a local sales tax, at a rate of up to 1% for general or specific purposes, even if this tax, when combined with other local taxes, would exceed the usual 2% limit set by state law. This exception requires the City Council to approve the tax and for voters to subsequently approve it, and the tax must otherwise follow the state's Transactions and Use Tax Law. The bill also amends existing law to allow funds from the Bay Fill Clean-Up and Abatement Fund to be used for supporting enforcement activities related to the San Francisco Bay, including funding technology, services, programs, and personnel that directly support these purposes, in addition to existing uses like resource enhancement and cleanup. The Legislature has declared that a special law is needed for Hercules due to its unique fiscal needs.
