This bill amends the Housing Accountability Act to revise the definition of a "housing development project" for mixed-use developments, specifically targeting the inclusion of transient lodging. Under the new provisions, mixed-use developments must ensure that no portion of the project is designated for use as a hotel, motel, bed and breakfast inn, or other transient lodging, with some exceptions. If a mixed-use project does include such transient lodging, only the non-lodging portion of the project can be considered a housing development project, and this portion must still meet the requirement that at least two-thirds of the new or converted square footage is designated for residential use. The bill also allows for separate approval of the transient lodging portion, which would not be eligible for housing development project benefits. Exceptions are made for residential hotels and situations where a residential unit is used or marketed as short-term lodging after the certificate of occupancy is issued. The legislation is part of California's ongoing efforts to address the state's housing shortage and increase housing affordability by making it easier to approve and develop housing projects.
