This bill modifies existing California law regarding municipal wastewater agencies by extending the timeline for filing agreements related to stormwater management. Currently, when a municipal wastewater agency enters into a new agreement or amends an existing agreement with entities responsible for stormwater management (such as municipal, industrial, and commercial stormwater dischargers), they must file a copy of that agreement with the local agency formation commission within 30 days. The bill changes this requirement to extend the filing deadline to 40 days. The legislation allows municipal wastewater agencies to continue their existing powers, which include authorizing stormwater discharge into wastewater systems, enforcing water quality requirements, and levying fees to fund related projects. Importantly, the bill does not require the local agency formation commission to approve these agreements, except as already mandated by existing reorganization act provisions. This change provides municipal wastewater agencies a slightly longer window to complete the required paperwork after establishing or modifying stormwater management agreements.
