This bill amends existing California law regarding housing preferences for transgender, nonbinary, and intersex individuals in state prisons by introducing a significant restriction. Currently, such individuals can be housed in a correctional facility based on their gender preference. The new legislation would require the Department of Corrections and Rehabilitation to deny housing preferences and instead house individuals in facilities consistent with their anatomical sex if they have been convicted of, or have credible evidence of committing, specific serious offenses against victims of the opposite gender. These offenses include murder, voluntary manslaughter, mayhem, robbery, kidnapping, domestic violence, criminal threats, rape, sexual offenses, human trafficking, assault, and threats to victims or witnesses, as well as conspiracies or attempts to commit such crimes. The bill maintains protections for individuals' gender identity in other aspects of incarceration, such as being addressed consistently with their gender identity and having their safety considerations taken seriously, but introduces this new limitation specifically for individuals with a history of certain violent or sexual offenses committed against victims of the opposite gender.
