This bill amends the existing Used Mattress Recovery and Recycling Act to modify how mattress recycling charges are collected and communicated. Under the updated legislation, distributors, retailers, or sellers may now pay the mattress recycling charge directly to the mattress recycling organization on behalf of the consumer, provided they enter into a written agreement to do so. While previously the charge had to be clearly shown as a separate line item on invoices, this requirement is now optional when the seller pays the charge directly. The bill also explicitly requires these sellers to educate consumers about mattress recycling options and free drop-off services. The mattress recycling charge, which is added to the purchase price of each mattress, remains in place to fund the recycling program administered by the Department of Resources Recycling and Recovery. The legislation aims to provide more flexibility in how the recycling charge is handled while maintaining the goal of promoting mattress recycling and consumer awareness about recycling options.
