This bill, titled the "Ethics Over Aesthetics Act," prohibits the importation for profit, sale, or offering for sale in California of transgenic pet animals that possess a "cosmetic transgenic trait," which is defined as a trait that alters an animal's appearance or natural functions, such as novel coloring or the removal of claws or vocal cords. However, this prohibition does not apply if the genetic alteration benefits the animal's health, such as making it resistant to disease, or if it enhances human interaction without altering natural functions, such as creating hypoallergenic traits. The bill also exempts certain aquatic pet animals produced through specific breeding or manipulation methods that do not involve transgenic organisms. Violations of this act are considered separate offenses, each punishable by a civil penalty of at least $5,000, which can be enforced by county district attorneys or city attorneys.
