This bill requires the commissioner of state health services to issue a statewide order that allows licensed pharmacists to dispense ivermectin (a medication typically used to treat parasitic infections) without a prescription from a healthcare practitioner. The order must include written, standardized procedures for pharmacists to follow and require pharmacists to provide patients with instructions on how to use ivermectin properly. Pharmacists who dispense ivermectin in accordance with this order will be protected from criminal, civil, and professional disciplinary liability, as long as they act in a reasonably prudent manner. Pharmacists will also be required to submit an annual written report detailing the number of ivermectin doses they have dispensed. The executive commissioner and the Texas State Board of Pharmacy are authorized to adopt rules to implement this new law, and the commissioner who issues the statewide order cannot be held liable for doing so. The bill will take effect immediately if it receives a two-thirds vote in the Texas legislature; otherwise, it will take effect on September 1, 2025.
