This bill amends Section 212.012(c) of the Local Government Code to expand the circumstances under which utility entities can serve or connect land with utility services. Specifically, the bill adds a new provision that allows an entity to serve or connect land with water, sewer, electricity, gas, or other utility services if the land was removed from a municipality's extraterritorial jurisdiction (ETJ) under Subchapter D or E of Chapter 42, and the entity holds a certificate of convenience and necessity to serve the land. The bill builds upon existing provisions that already allowed utility service under certain historical conditions, such as land being served before specific dates in 1987 and 1989. The legislation aims to clarify and broaden the rights of utility providers to serve lands that have been detached from a municipality's extraterritorial jurisdiction. The bill will take effect immediately if it receives a two-thirds vote in both legislative chambers, or otherwise on September 1, 2025.
