The bill establishes specific restrictions on these NIL contracts, such as prohibiting compensation for athletic performance, endorsements of certain products like alcohol or tobacco, and contracts that extend beyond an athlete's participation in intercollegiate athletics. Students must disclose proposed NIL contracts to their institution and ensure the contracts do not conflict with team contracts, institutional policies, or honor codes. The bill also clarifies that student athletes are not considered employees of their institutions and cannot use institutional facilities, uniforms, or logos for NIL contracts without explicit permission. These changes will apply only to NIL contracts entered into on or after the bill's effective date, which will be either immediately upon receiving a two-thirds vote in the Texas legislature or September 1, 2025, if that threshold is not met.
