This bill revises provisions related to medical billing by introducing new requirements for medical facilities and billing entities when patients dispute charges. If a patient notifies a medical facility or billing entity about potential overcharges, the organization must investigate within 30 days and respond by either explaining whether they will cancel or refund the disputed amount, or by providing contact information for the Office for Consumer Health Assistance. The bill mandates that during the investigation, the facility cannot bill the patient for the disputed care. If an overpayment is confirmed, the medical facility or billing entity must refund the patient within 60 days, with the option to apply the refund to other outstanding bills. Failure to comply with these requirements can result in administrative fines up to $5,000, which is 10 percent of the overpayment amount. Additionally, the bill expands the role of the Governor's Consumer Health Advocate to include reviewing potentially erroneous medical bills and assisting consumers in addressing overcharges and overpayments, thereby providing an extra layer of consumer protection in healthcare billing.
