Bill Summary
This bill relates to the controlled substance crystalline polymorph psilocybin. Current law categorizes the controlled substance psilocybin as a schedule I, hallucinogenic substance (Code section 124.201(4)(s)). The bill provides that notwithstanding Code section 124.204(4), a drug that contains the pharmaceutical composition of crystalline polymorph psilocybin shall be immediately removed from schedule I upon its approval by the United States food and drug administration and rescheduled based upon the recommendations of the United States food and drug administration and its listing in the federal Controlled Substances Act. The bill provides that upon the rescheduling of psilocybin, S.F. _____ it shall be lawful to prescribe, distribute, and market the pharmaceutical composition of crystalline polymorph psilocybin. Current penalties for the possession of psilocybin range from a serious misdemeanor to a class “B” felony.
AI Summary
This Study Bill proposes to change how crystalline polymorph psilocybin, a form of psilocybin that is currently classified as a Schedule I hallucinogenic substance under state law, is regulated. Specifically, it states that if a drug containing this pharmaceutical composition, such as COMP 360, receives approval from the United States Food and Drug Administration (FDA), it will be automatically removed from Schedule I and reclassified based on the FDA's recommendations and federal law. Upon this rescheduling, it would then become legal to prescribe, distribute, and market this specific pharmaceutical form of psilocybin, which is a significant shift from current laws where possession of psilocybin carries penalties ranging from a serious misdemeanor to a felony.
