This bill requires the Agency for Health Care Administration to conduct a comprehensive fiscal impact study on implementing several provisions related to the 340B Drug Pricing Program in Medicaid pharmacy operations. The study will explore mandating drug manufacturers to sell certain drugs to Medicaid pharmacies at 340B discounted prices (which is a federal program that allows certain healthcare organizations to purchase outpatient drugs at reduced prices), requiring manufacturers to pay rebates if the 340B price exceeds the state's negotiated price, compelling pharmacy benefits managers to pay pharmacies the 340B discounted price plus a professional dispensing fee, and requiring drug wholesalers to sell drugs at 340B prices for preferred Medicaid drugs. The bill also stipulates that Medicaid pharmacies can only provide 340B-discounted drugs to Medicaid recipients. The agency must complete the study and submit its findings to the Governor, Senate President, and House Speaker by January 31, 2026, with the goal of potentially implementing these cost-saving and price-transparency measures in the state's Medicaid pharmacy system. The act will take effect immediately upon becoming law.
