This bill amends the public health law to prohibit the sale of flavored smokeless tobacco within 500 feet of any public or private elementary or secondary school. The bill defines "flavored smokeless tobacco" as any tobacco or nicotine product intended for oral use that contains a characterizing flavor, which is a distinguishable taste or aroma other than tobacco, including flavors like fruit, chocolate, vanilla, candy, mint, or menthol. The distance measurement will be taken in a straight line from the property line of the school to the property line of the business selling the product. Enforcement of this restriction will follow existing tobacco sales regulations, and any person can submit a complaint to an enforcement officer if they believe a violation has occurred. The law will take effect 180 days after it becomes official, giving businesses time to adjust to the new requirements and potentially relocate or modify their product offerings to comply with the school proximity restriction.
