Bill Summary

This bill modifies the manner in which the financial responsibility of educating a student who moves to a new school district as a result of becoming homeless is determined. Under current law, the "district of residence" is defined as the school district in which the student's parent or guardian resided prior to becoming homeless. This district is responsible for determining the school district in which the homeless student will enroll and for paying any tuition and transportation costs. Under the provisions of this bill, the school district in which the student resided prior to becoming homeless would still be responsible for determining the student's educational placement and for the student's educational costs for the remainder of the school year. In subsequent school years, the district in which the student attends school will become the district of residence and will assume the fiscal responsibilities for the homeless student.

AI Summary

This bill modifies the financial responsibility and educational placement for students who become homeless and move between school districts. Under the new provisions, for the remainder of the current school year, the school district where the student's parent or guardian last resided before becoming homeless will remain responsible for determining the student's educational placement and paying associated costs. In subsequent school years, the district where the homeless student actually attends school will become the district of residence and assume fiscal responsibilities. The bill defines "homeless" as an individual who temporarily lacks a fixed, regular, and adequate residence. When determining educational placement, the district must consult with the parent or guardian and choose the option that is in the child's best interest, which could include continuing education in the last attended district, enrolling in the district of previous residence, or enrolling in the district where the child is temporarily living. If there is a disagreement about placement, the executive county superintendent of schools will make a determination within 48 hours based on state board criteria. The goal of the bill is to provide stability and support for homeless students during a potentially challenging time, ensuring their educational needs are met with minimal disruption.
