This bill amends existing New Jersey law concerning employer payroll taxes, allowing municipalities to retain up to three percent of collected employer payroll taxes to cover administrative costs. It also clarifies that if an out-of-state municipality or entity imposes an employer payroll tax on an employee for services performed out-of-state, a New Jersey municipality cannot impose its own employer payroll tax on that employee, provided the employer submits documentation to the municipality proving the out-of-state tax liability. Furthermore, the bill allows the Director of the Division of Taxation to share employer-provided wage and tax withholding information with designated municipal officers for the specific purposes of verifying reported payroll information and identifying employers who are subject to the local payroll tax but have failed to report their payroll. This sharing of information is intended to aid in the administration of local employer payroll taxes.
