This bill, known as "Ethan's Law," aims to address firearm safety in homes by requiring secure gun storage and establishing penalties for unsafe firearm storage. The bill finds that millions of minors live in homes with unsecured firearms, and such access increases risks of unintentional shootings, youth suicide, and school violence. Under the proposed law, it would be unlawful for a person to store a firearm in a residence if they know or should know that a minor could access the firearm without permission or that a resident is legally prohibited from possessing a firearm. Firearm owners can avoid penalties by using a secure gun storage device, keeping the firearm in a location a reasonable person would consider secure, or carrying the firearm on their person. Violations would result in a $500 fine, and if the improperly stored firearm is used to cause injury or death, the owner could face up to 5 years in prison and additional fines. The bill also establishes a Firearm Safe Storage Program that provides grants to states and Indian Tribes that enact similar safe storage laws, and includes a provision clarifying that failure to securely store a firearm could be considered legal negligence if the firearm causes harm.
