This bill prohibits cities, towns, villages, and joint water districts from imposing any levies, charges, taxes, or assessments on properties that use private well water as their water supply, even when a municipal or joint water district exists or is established in the area. Similarly, the bill prevents cities, towns, and villages from imposing such financial obligations on properties that use septic systems for wastewater treatment, regardless of the establishment of a municipal or joint sewer district. In essence, the legislation protects property owners who have independent water and waste management systems from being required to pay additional fees or taxes to municipal water or sewer districts, even if those districts are created in their locality. The bill would amend the general municipal law by adding a new section (§ 120-dd) to explicitly outline these prohibitions, and it is set to take effect immediately upon enactment.
