This bill amends New York's real property law to prohibit certain noncitizens, foreign governments, and foreign entities from purchasing or holding real property zoned as industrial, agricultural, or residential agricultural. Specifically, the bill restricts property ownership for entities from "foreign countries of particular concern" as identified by the U.S. Department of State. This includes governmental entities, companies primarily owned or controlled by such foreign entities, and individual citizens from these countries. The restrictions apply to various types of industrial and agricultural zoned properties, preventing these specified foreign actors from acquiring such real estate within New York State. Prior to this bill, noncitizens were generally able to hold and transfer real property in the same manner as U.S. citizens, but this legislation creates a specific carve-out for entities from countries deemed of "particular concern" by establishing new limitations on their property ownership rights. The bill includes a severability clause, meaning that if any part of the law is found invalid by a court, the rest of the law will remain in effect.
