This bill establishes comprehensive regulations for the decommissioning of solar energy facilities in Pennsylvania, requiring solar energy facility owners (grantees) to develop detailed decommissioning plans and provide financial assurance for the eventual removal and restoration of solar sites. The bill mandates that solar energy facility agreements include provisions for decommissioning within 18 months after a facility stops producing electricity, with specific requirements for financial assurance that increase incrementally over 25 years, starting at 10% of estimated decommissioning costs and ultimately reaching 100% less salvage value. The decommissioning plan must include removing equipment and structures to at least three feet below grade, restoring the property to its pre-construction condition, and reseeding cleared areas, unless otherwise agreed upon by the property owner. Additionally, the bill requires grantees to attest to compliance with laws preventing forced labor in the production of solar equipment and preempts local ordinances that might interfere with these regulations. The requirements do not apply to small solar facilities (two megawatts AC or less), customer-generated solar systems, or solar facilities on agricultural operations.
