This bill introduces the Solar Energy Facility Location Act, which establishes guidelines for solar energy facility development in Pennsylvania while providing tax incentives and land use restrictions. The legislation prohibits solar facilities from being located on Class 1 or Class 2 agricultural lands, as classified by the Natural Resource Conservation Service, and requires property owners to obtain a soil classification certification from the Department of Agriculture before leasing land for solar projects. The bill provides a tax credit of 3 cents per kilowatt, not exceeding 30% of the project's electricity generation cost, for the first 10 years of operation, with an annual state tax credit limit of $5 million. Eligible lands for solar facilities include brownfields, abandoned mines, capped landfills, warehouse rooftops, and parking facility canopies. The tax credit is available on a first-come, first-served basis and requires applicants to have filed all state tax reports and paid any outstanding tax balances. The bill exempts certain solar projects from these requirements, such as facilities with a capacity of two megawatts or less, projects already in progress, and customer-generator installations. The Department of Agriculture, Attorney General, or local municipalities can enforce the act's provisions, and the legislation will take effect 60 days after its passage.
