This bill establishes a five-year moratorium on the land application, sale, distribution, and use of biosolids (accumulated semi-solids from sewage treatment plants) in New York State due to concerns about PFAS (per- and polyfluoroalkyl substances), a class of synthetic chemicals. The moratorium applies to biosolids from public and private wastewater treatment facilities, including their use as fertilizers, soil amendments, mulch, or in agricultural and non-crop land applications. The bill does not restrict the disposal of these materials in solid waste landfills or the use of compost and agricultural products derived from food waste, crops, manure, or other non-biosolids sources. Violations of the moratorium can result in penalties up to $2,500 per violation, with an additional $500 daily fine for continuing violations, and potential injunctive relief. Penalties would be enforced by the attorney general at the request of the commissioner. The act will take effect 60 days after becoming law, and includes a severability clause to ensure that if any part of the law is found invalid, the rest of the law remains in effect.
