This bill modifies the Government Code to enhance the confidentiality of administrative subpoenas issued by Internet Crimes Against Children (ICAC) task forces during investigations of online sexual exploitation of minors. Specifically, the bill allows prosecuting attorneys or ICAC task force officers to issue subpoenas with provisions that prevent electronic communication services or remote computing services from disclosing: (1) the existence of the subpoena, (2) details about the records or documentation requested, and (3) whether any records have been provided in response to the subpoena. These provisions are designed to protect sensitive investigations by preventing potential suspects from being alerted to ongoing legal inquiries. The bill requires that if such confidentiality restrictions are imposed, the subpoena must explicitly state the determination of the prosecuting attorney or ICAC officer. The changes will apply only to subpoenas issued on or after the effective date of September 1, 2025, ensuring that existing subpoenas remain governed by previous legal standards.
