This bill creates a legal mechanism for individuals to sue someone who intentionally transmits intimate images to their electronic device without consent, with the intent to harass, degrade, or humiliate them. An "intimate image" is defined as a picture depicting sexual conduct or uncovered human genitals. To successfully bring a civil action, the plaintiff must prove that the defendant transmitted the image after turning 18, with the intent to cause harm, knew the plaintiff did not consent, and that a reasonable person would feel harassed or humiliated by the transmission. The bill allows plaintiffs who prevail in such a lawsuit to recover either their economic and noneconomic damages (up to $10,000) or $500, whichever is greater, and mandates that the court award reasonable attorney fees. The lawsuit must be filed within two years of the incident. Importantly, the bill includes protections for certain entities like internet service providers, mobile data providers, online applications, transmission services, and healthcare providers, who cannot be sued for transmitting such images under specific circumstances. The bill would apply to claims arising on or after its effective date in 2025.
