Amend The South Carolina Code Of Laws By Adding Section 16-11-635 So As To Provide That A Person Who, Without Legal Cause Or Good Excuse, Enters A Transportation Facility, Including Any Public Transportation And Any Public Transportation System, After Having Been Warned Not To Do So By The Transit Director Or His Designee, Is Guilty Of A Misdemeanor Triable In A Municipal Or Magistrates Court, To Provide Procedures For A Written Warning And For Appealing The Warning, And To Provide That The Provisions Of This Section Must Be Construed As In Addition To, And Not As Superseding, Another Statute Relating To Trespass Or Unlawful Entry On Lands Of Another.

AI Summary

This bill establishes new legal provisions for trespassing in transportation facilities in South Carolina, creating a specific misdemeanor offense for unauthorized entry after being warned. Under the proposed law, transit directors or supervisors can request individuals who commit prohibited acts or criminal offenses to leave transportation facilities and provide a written warning that specifies the duration of their prohibition from returning. The warning must be given in the presence of a law enforcement officer and include details about the alleged violation and an appeals procedure. If a person enters a transportation facility during their prohibited period without legal cause or good excuse, they can be charged with a misdemeanor punishable by a fine up to $200 or imprisonment up to 30 days. The individual has the right to appeal the warning by submitting a hearing request to the transit authority's board within five business days, which must then provide a hearing within ten business days. The law is designed to be complementary to existing trespassing statutes and applies to all public transportation facilities and systems within a transit authority's jurisdiction, providing a clear framework for addressing unauthorized access and disruptive behavior.
