This bill modifies how the weight of fluid in water pipes is treated in Minnesota's controlled substances laws across four different sections of the state statutes. Instead, the bill now explicitly states that the weight of fluid used in a water pipe cannot be considered when calculating the total weight of a controlled substance mixture for determining the severity of drug possession charges. This change applies to first, second, third, and fifth-degree controlled substance crime definitions, which involve different quantities of various drugs like cocaine, methamphetamine, heroin, fentanyl, and cannabis. The bill clarifies that for the purposes of these laws, a mixture does not include the fluid in a water pipe or any controlled substance dissolved in that fluid. The amendments are designed to standardize how drug possession is measured and potentially reduce the weight calculations that could elevate a drug possession charge to a more serious degree. The bill becomes effective the day following its final enactment.
