This bill makes it unlawful for anyone under the age of 21 to possess tobacco or vaping products, which are defined as electronic cigarettes or associated products. If found in possession, an individual may be subject to a civil fine of up to fifty dollars, completion of a tobacco awareness program, or up to thirty hours of community service, but they will not be arrested or considered a criminal. Law enforcement officers are authorized to seize any tobacco or vaping products found in the possession of individuals under 21, and these seized items will be disposed of unless a court orders their return, which can happen if the seizure was improper or if returning the product is in the interest of justice.
