Bill Summary

AN ACT To amend Title 16, Chapter 4 of Title 30, and Chapter 6 of Title 40 of the Official Code of Georgia Annotated, relating to crimes and offenses, rights of persons with disabilities, and uniform rules of the road, respectively, so as to change references to assistance and guide dogs to service dogs; to provide for definitions and conforming changes; to provide for a criminal penalty for a person who interferes with, causes death, or physical harm to a service dog; to provide for exceptions; to provide for restitution; to revise provisions relating to the use and training of service dogs; to provide for a penalty for persons who misrepresent the need for a service dog; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill updates Georgia law to consistently refer to "service dogs" instead of "assistance dogs" or "guide dogs," clarifying that a service dog is a canine individually trained to perform specific tasks for a physically or mentally impaired person. It establishes criminal penalties for interfering with, harming, or causing the death of a service dog, with penalties escalating for more severe offenses, and mandates restitution for veterinary costs, training, and replacement value of the dog. The bill also creates a penalty for individuals who falsely claim to need a service dog to gain accommodations or rights, and it revises provisions regarding the rights of individuals with disabilities to be accompanied by service dogs in public accommodations, housing, and on public transportation, while also outlining specific requirements for service dogs in training and their handlers.
