This bill relates to limitations on the sale and regulation of consumer fireworks. The bill allows for consumer fireworks to be sold from a permanent structure at any time throughout the year. Current law prohibits the sale of fireworks from a permanent structure on dates other than between June 1 and July 8 and between December 10 and January 3. The bill does not amend the current restriction on the sale of fireworks from a temporary structure (June 13 to July 8). The bill prohibits a county board of supervisors or city council from restricting or limiting the use of consumer fireworks, display fireworks, or novelties, as described in Code section 727.2, on July 3, July 4, or December 31 in accordance with Code section 727.2(4). Under current law, Code section 727.2(4) provides that a person shall not use or explode consumer fireworks on days other than June 1 through July 8 and December 10 through January 3 between the hours of 9:00 a.m. and 10:00 p.m. with the following exceptions: on July 4 and the Saturdays and Sundays immediately preceding and following July 4, between the hours of 9:00 a.m. and 11:00 p.m.; between the hours of 9:00 a.m. on December 31 and 12:30 a.m. on January 1; and between the hours of 9:00 a.m. and 11:00 p.m. on the Saturdays and Sundays immediately preceding and following December 31.
