This bill modifies Rhode Island's motor vehicle insurance mandatory arbitration law by increasing the maximum claim amount eligible for mandatory arbitration from $50,000 to $100,000. Under the current law, individuals who suffer property damage, bodily injury, or death resulting from a motor vehicle incident can choose to submit their claim to arbitration if the amount is $50,000 or less. The bill raises this threshold to $100,000, allowing more cases to be resolved through an informal arbitration process. The arbitration procedure remains largely unchanged, including the selection of an arbitrator from the court's arbitration program, providing seven days' notice for a hearing, and maintaining the option for either party to request a jury trial within 60 days of the arbitrator's decision. The bill also preserves the existing requirement that individuals with motor vehicle liability insurance agree to be bound by these arbitration provisions when applying for or renewing a driver's license or registering a vehicle. The bill will take effect immediately upon passage.
