This bill introduces new requirements for healthcare providers and practitioners to refund patient overpayments within 30 days of determining an excess payment occurred. Specifically, the bill creates two new sections of Florida Statutes (408.12 and 456.0625) that apply to licensees and health care practitioners who "tender charges for reimbursement" - which means filing a claim with a government-sponsored program, private health insurer, or health maintenance organization. Under the new law, these providers must refund any patient overpayments within 30 days of identifying the excess payment. The bill also establishes penalties for non-compliance: the Agency for Health Care Administration can impose administrative fines up to $500 for licensees who fail to refund overpayments, and health care practitioners can face disciplinary action under existing professional conduct regulations. Certain types of overpayments covered by specific insurance statutes are exempted from these requirements. The law is set to take effect on January 1, 2026, giving healthcare providers and practitioners time to adjust their billing and refund processes to comply with the new regulations.
