This bill modifies the authority of the North Texas Groundwater Conservation District by requiring the district to consider whether a proposed water use includes supplying water to a pond or lake larger than two acres for landscape enhancement purposes when reviewing permit applications. Specifically, before granting or denying a permit or permit amendment under Section 36.1146 of the Water Code, the district must take into account whether the proposed well water will be used wholly or partially to provide water to a landscape pond or lake exceeding two acres in surface area. The new provision will only apply to permit applications submitted on or after the bill's effective date, which is either immediately upon receiving a two-thirds vote in the Texas legislature or September 1, 2025, if the immediate vote threshold is not met.
