This bill modifies existing cannabis regulations by authorizing local governments to have more control over cannabis businesses and sales. Specifically, local units of government can now prohibit the retail sale of cannabis products and the establishment of certain types of cannabis businesses, including microbusinesses, mezzobusinesses, retailers, and medical cannabis combination businesses. Local governments can also adopt reasonable restrictions on the time, place, and manner of cannabis business operations, including prohibiting businesses near schools, day cares, residential treatment facilities, and public park attractions used by minors. The bill allows local governments to limit the number of cannabis retailers to at least one per 12,500 residents and provides a mechanism for local governments to adopt interim ordinances restricting cannabis businesses while conducting studies or hearings. Additionally, the bill includes a provision requiring the Office of Cannabis Management to reimburse application fees for cannabis business license applicants who were prevented from operating due to local government prohibitions, provided they identified their intended location before the local government's restrictive action. This bill essentially provides local governments with more flexibility in regulating cannabis businesses within their jurisdictions while maintaining some standardized guidelines at the state level.
